Reorganization Update - Judge Sets "Bar Date"

MARCH 15, 2022 IS THE FINAL DAY FOR FILING PROOF OF SEXUAL ABUSE CLAIMS

BANKRUPTCY COURT APPROVES DEADLINE FOR PRE-PETITION CLAIMS,
FORMS OF PROOF, CONFIDENTIALITY PROTOCOLS & MANNER OF NOTICE

The United States Bankruptcy Court for the District of Connecticut, Hartford Division, has set a deadline for filing claims against The Norwich Roman Catholic Diocesan Corporation.

Bankruptcy Judge James J. Tancredi entered an order setting 5 p.m. Eastern Time on March 15, 2022, as the “Bar Date” for all persons and entities – including governmental units and individuals who have sexual abuse claims – to file pre-bankruptcy claims in the Chapter 11 bankruptcy case. 

The Bar Date applies to any person asserting claims against the Diocese, whether the claims are secured, unsecured priority, or unsecured non-priority. Those who do not file timely claims will not be treated as creditors, will not be entitled to vote on whether to accept or reject a plan of reorganization and will not share in any distribution of funds or other compensation in the Chapter 11 bankruptcy case.

Judge Tancredi also approved the form of confidential Sexual Abuse Proof of Claim form and a rigorous Confidentiality Protocol to maintain the confidentiality of filed abuse claims. The Court also approved the Publication Notice and processes the Diocese must use to notify potential claimants about the Bar Date and other proof of claim filing procedures.  

The court-approved Claims and Noticing Agent for the Diocese is Epiq Corporate Restructuring, LLC. Epic is handling the Sexual Abuse Proof of Claim forms subject to the Confidentiality Protocol. Claimants may also file a Sexual Abuse Proof of Claim Form with the Clerk of the U.S. Bankruptcy Court for the District of Connecticut, Hartford Division; however, claims filed with the Bankruptcy Court Clerk will be available to the public and not subject to the Confidentiality Protocol, and may not be kept confidential.
